Dr Nyaho-Tamakloe, a founding member of the New Patriotic Party (NPP) and veteran statesman, has questioned the legitimacy of the Ghana Bar Association (GBA) to call for changes to the 1992 Constitution.
According to Nyaho-Tamakloe, the GBA has no right to demand constitutional changes.
Dr Nyaho-Tamakloe further recounted the GBA association’s refusal to participate in the drafting of the 1992 Constitution more than three decades ago.
Dr Nyaho-Tamakloe explained that the Ghana Bar Association wasn’t part of the creation of the 1992 Constitution, revealing that they never attended any meeting they were called upon to attend.
He argued that since the Association declined to serve on the Board, it has no genuine basis to demand changes to the Constitution.
Speaking in an interview on Onua TV’s Maakye programme on Tuesday, September 8, 2026, “Most of you don’t know, but you will be surprised that the Ghana Bar Association wasn’t part of the Constitution (Constitutional Board). They refused to be part, and so if today we have problems there, they have no right to comment on it”.
He further revealed that ideas of ordinary workers, like tailors, hairdressers and carpenters, were incorporated in the drafting of the 1992 Constitution.
He emphasised that the GBA cannot ask that the Constitution be changed when they refused to participate in its drafting more than three decades ago.
“The constitution you have there even has the ideas of hairdressers and carpenters. So you can’t all of a sudden say that you want the constitution changed. Because one of the clauses they are asking to be changed cannot be changed easily,” he emphasised.
Meanwhile, President John Dramani Mahama has announced plans to hold a national referendum on proposed constitutional amendments.
According to President Mahama, the planned national referendum on proposed constitutional amendments will be held alongside the 2027 District Assembly Elections.
Speaking on his Resetting Ghana Tour Citizens’ Engagement in Bolgatanga as part of his two-day tour of the Upper East Region, Mahama stated, “We therefore want to add the referendum to the District Assembly elections next year. Next year, apart from voting for your Assembly Members, you will also be required to vote on the constitutional amendments”.
“If the referendum is successful, we will implement the amendments to the entrenched clauses. That is what we are doing with regard to governance.”
He further revealed that he will soon inaugurate the Constitutional Review Implementation Committee to take the Government’s position paper and the Constitutional Review Commission’s reports and synthesise the two.
“For non-entrenched clauses, we only need Parliamentary approval. We will put them before Parliament, and Members will vote and pass them,” he said.
“Entrenched clauses require that we conduct a referendum. At least 40 percent of registered voters must vote, and 75 per cent of those who vote must say yes.”
It will be recalled that President John Dramani Mahama labelled the proposal by the Constitution Review Committee as revolutionary and radical.
According to President Mahama, some of the recommendations are revolutionary and radical, but in the interest of Ghana’s democracy.
President Mahama stressed that the recommendations are necessary to strengthen governance and restore public confidence in democratic institutions, noting that several countries in the subregion are experiencing coups.
