Supreme Court orders EC to halt Kpandai rerun

NewsSupreme Court orders EC to halt Kpandai rerun

The Supreme Court has ordered the Electoral Commission (EC) to halt all proceedings and activities leading to the conduct of the Kpandai parliamentary rerun.

The court directed the EC to suspend all proceedings pending the final determination of a case before the court.

The Supreme Court decision puts a hold on preparations by the EC for the rerun election until the legal issues surrounding the matter are fully resolved.

In court today, the Supreme Court adjourned proceedings to January 13, 2026, this is to  allow for further consideration of the issues raised by the parties involved.

In Court, counsel for the applicant, Gary Nimako Marfo, told the court that the NDC candidate Daniel Nsala Wakpal had not been served with the judicial review application.

He therefore requests the court to allow substituted service.

A five-member panel, presided over by Justice Pwamang, with Justices Kulendi, Tanko, Samuel Asiedu, and Henry Kwofie, granted the request.

The Supreme Court ordered that service on the NDC candidate be effected within seven days, after which service would be deemed effective.

Mathew Nyindam, in his application, argued that the Tamale High Court erred in assuming jurisdiction over the election petition filed by the NDC candidate Daniel Nsala Wakpal.

He is seeking judicial review to quash the High Court’s judgment, together with all processes and proceedings following the court decision.

It will be recalled that the Tamale High Court, on November 24, 2025, ordered the rerun of the Kpandai parliamentary election within 30 days.

According to the High Court, the Electoral Commission has within 30 days from today to conduct the rerun.

His Lordship Emmanuel Brew Plange made this declaration following the legal challenge of the 2024 parliamentary election by the former Member of Parliament (MP) and the NDC, Daniel Nsala Wakpal.

Out of court, the Electoral Commission of Ghana (EC) had earlier announced the Kpandai Parliamentary election rerun will be held on Tuesday, December 30.

In a statement signed by the Deputy Director of Research Mr Fred Tetteh read, “The Electoral Commission wishes to inform the General Public that following the Tamale High Court’s ruling on Monday, 24th November, 2025, ordering a rerun of the “Kpandai Constituency Parliamentary Election within thirty (30) days” and upon receipt of a letter from the Clerk to Parliament on Tuesday, 9th December, 2025, formally notifying the Commission of the occurrence of a vacancy in the Membership of Parliament, the seat of the Constituency in Parliament has become vacant.

The Electoral Commission will hold a rerun of the Parliamentary Election in the Kpandai Constituency on Tuesday, 30th December, 2025.

The rerun of the Kpandai Constituency Parliamentary Election will be conducted for only the three (3) Candidates who contested the 2024 Parliamentary Election in the said Constituency”.
