“We will appeal scandalous High Court ruling” – Akosua Serwaa’s Lawyer

The legal counsel for Akosua Serwaa, wife of the late Daddy Lumba, William Kusi, has revealed that her client has ordered him to appeal the Kumasi High Court decision.

According to William Kusi, as a learned professional, he cannot align himself with decisions he described as scandalous.

Speaking in an interview with Dadzie TV on November 28, 2025, William Kusi stated, “I am a learned person, and I can’t align myself with decisions which are scandalous, and I cannot defend. I just spoke with my client, and she said we should appeal against it, and I agree with her. We will prosecute and appeal”.

“She said Akosua Serwaa was unable to prove that she married Lumba in Germany. In fact, she said something like, ‘As for marriage in Germany, it is proven by documents, so if someone claims by just word of mouth that they got married in Germany, it’s not enough unless there is documentation.’ She added that the documents we brought to court cannot be accepted because Akosua Serwaa’s and Lumba’s signatures are not in them,” he explained.

He added, “The most scandalous part of her statement was that she said we only went to forge some documents to claim it is a certificate, which impugns our integrity as lawyers. To me, it’s scandalous”.

Akosua Serwaa’s appeal decision follows, the Kumasi High Court declaring that Akosua Serwaa Fosuh and Priscilla Ofori, popularly known as Odo Broni, as the surviving spouses of the late highlife legend Daddy Lumba.

The court presided over by Justice Dorinda Smith‑Arthur ruled that Akosua Serwaa cannot be declared the sole surviving spouse, as the evidence she provided did not affirm her claims.

During proceedings on Friday, November 28, evidence showed Odo Broni was customarily married to Daddy Lumba before his passing.

The court also highlighted that Akosua Serwaa was customarily married to Daddy Lumba, but rejected her alleged German marriage certificate presented as it was not an original certificate.

The court ruled that both Akosua Serwaa and Odo Broni are recognised as surviving wives of Daddy Lumba and must be acknowledged by the Abusuapanyin in the performance of the widowhood rites.

 The plaintiff, Akosua Serwaa Fosu, was seeking a court declaration that she is the only surviving wife of the late musician, allowing her to have exclusive authority to carry out all widowhood rituals.

She was also demanding that the court restrain Odo Broni from falsely claiming to be the late singer’s wife.

Meanwhile, out of court, the family of highlife icon Charles Kwadwo Fosu, commonly known as Daddy Lumba, has said the late music icon’s funeral, slated for December 13, 2025, is unauthorised, misleading and does not reflect the family’s decision.

Lumba’s family, in their statement, further dismissed a widely circulated funeral date of December 13, 2025, adding that the date was unauthorised, misleading, and not reflective of any family determination.

The late Daddy Lumba’s family sighted that the proposed date was never agreed upon and is impracticable due to ongoing autopsy processes and investigations in Ghana and Germany, also Children abroad preparing for major examinations.

They further detailed that family members require adequate notice to apply for leave, with International mourners needing time to make travel arrangements.

The family further accused Abusuapanyin Kofi Owusu of illegally withdrawing GHS 200,000 from a CalBank account.

In a statement issued on Monday, November 24, the family revealed that Abusuapanyin Kofi Owusu had illegally withdrawn GHS 200,000 despite a court directive barring him from performing financial transactions.
