The company is seeking to restrain the Minister for Lands and Natural Resources and the Minerals Commission from taking possession of the mine or transferring its mineral rights to third parties while the court determines the legality of the termination of its mining lease.

The Attorney-General has also been named as a respondent in the application, which was filed at the Commercial Division of the High Court.

The legal action follows a security operation at the mine on Thursday, October 22, 2026, during which military and police personnel reportedly took control of the site, removed security guards and directed workers to leave the premises.

In a supporting affidavit, the company’s Administrative Manager, Jonathan Adongo, alleges that Minerals Commission officials, accompanied by military personnel, ordered the company, its employees and workers to vacate the mine, offices and residential accommodation by midday on the same day.

He also described the threatened takeover as imminent and urged the court to hear the application urgently.

Jonathan Adongo stated, “The threatened military takeover is imminent, and I humbly pray this Honourable Court to hear this application with urgency”.

Northern Ashanti Mines is challenging a termination notice dated April 30, 2026, issued by the Minerals Commission on behalf of the Minister for Lands and Natural Resources.

The notice stated that the company had failed or refused to remedy breaches within the statutory and regulatory timeframe. However, NAMCL disputes the allegation, insisting that it was not served with any notice of breach or allowed to address the alleged violations before its lease was terminated.

The company also says its lawyers wrote to the relevant authorities on May 4 and submitted a petition on May 20 seeking a review and reversal of the decision, but received no response.

According to the affidavit, Northern Ashanti Mines, formerly known as Owere Mines Limited, is redeveloping the historic Konongo Gold Mine in the Ashanti Region.

The company says its mining lease was renewed on February 2, 2023, for 13 years, covering approximately 125 square kilometres. It maintains that Parliament ratified the renewed lease, which is due to expire on February 1, 2036.

They further disclosed that it has committed more than US$83.34 million to the concession and recently secured an additional facility exceeding US$30 million to develop a gold processing plant. The facility, according to the company, is being used for a plant that is more than 50 per cent complete.

The company estimates its total committed investment at approximately US$110 million and says its operations support about 422 jobs, both directly and indirectly.

In its injunction application, Northern Ashanti Mines is asking the court to prevent the authorities from enforcing the lease termination through security deployments, taking over the concession or granting or transferring the mineral rights to other parties before the substantive dispute is resolved.

It argues that a forced takeover could put employees and surrounding communities at risk, damage equipment and result in the loss of exploration records and geological data.

The company is therefore seeking to preserve its possession of the mine until the court makes a final determination on its judicial review application challenging the termination of the mining lease.
