Private legal practitioner Martin Kpebu has said the Office of the Special Prosecutor (OSP) is gambling with charges levelled against former finance minister Ken Ofori-Atta and seven others in the SML case.

Lawyer Kpebu raised concerns over the charges filed by the OSP, describing the charges as questionable.

According to Lawyer Kpebu, he does not trust the Special Prosecutor Kissi Agyebeng after he allowed Ofori-Atta to escape the country.

Speaking on Eyewitness News with Umaru Sanda Amadu on Tuesday, November 18, Kpebu stated, “Kissi Agyebeng allowed Ofori-Atta to escape, so I cannot trust him. If you look at some of the charges he has filed, he’s deliberately gambling with financial loss. Financial loss is not part of the OSP’s mandate.

“Now you’re going to use this case to gamble. If you get to the court and it says no, as for financial loss, it’s too huge. What are you going to do? Is it part of the ploy to gamble?”

He added, “I don’t trust the charges at all. I cannot trust Kissi Agyebeng; he once worked for Ofori-Atta. Ofori-Atta is his formal client. Kissi worked for Gabby Asare Otchere-Darko. Same circle. Ask if Kissi Agyebeng ever attended a meeting with Ofori-Atta, and that man is going to prosecute Ofori-Atta, aaahbaai, what a joke.”

His comments come following the OSP formally charging Kenneth Nana Yaw Ofori-Atta and 7 others with 78 counts of corruption and corruption-related offences.

In a short statement on X on Tuesday, November 18, 2025, the OSP stated, “ The OSP this morning formally charged former Minister for Finance, Kenneth Nana Yaw Ofori-Atta and 7 others with 78 counts of corruption and corruption-related offences”.

Also, Martin Kpebu, in a separate interview, labelled the Special Prosecutor, Kissi Agyebeng, as a double agent.

According to Martin Kpebu, the Office of the Special Prosecutor (OSP) is engaged in double agent work, which Ghanaians cannot continue to deal with.

He boldly claimed that Kissi Agyebeng appears to be working for the people of Ghana, and at the same time serving the former finance minister Ofori-Atta’s interest.

Speaking in an interview with GhanaWeb, Martin Kpebu stated, “This double agent work, we cannot continue to deal with double agency. You are either working for the people of Ghana or you are not. But to be working, to appear to be working for the people of Ghana, and also be serving Ofori-Atta’s interest, we can’t accept that,” he said.

He added, “Because he said, ‘I intercepted the letter, I intercepted the letter,’ and you sat down and you allowed him to go.”

Lawyer Kpebu further confirmed reports that he has been summoned by the Office of the Special Prosecutor (OSP).

According to him, the OSP wants him to clarify some comments he made about the office.

He added, “They said the comments I’ve made, and that’s just effectively most of these things that I have here, that I should come and clarify. So I’ll go and clarify”.

“It’s even easier for me. It’s an opportunity for me to drum home the point that they should leave quickly… when they see my face, they will see that the guy means business. And I will be repeating it to them that they should go… the game is over”.
