Reports coming in suggest Kenpong Travel & Tours Limited, owned by former Assin Central MP Ken Agyapong, faces liquidation as First Atlantic Bank seeks recovery of GH¢2.55 million debt.

According to the reports,  First Atlantic Bank has petitioned Ghana’s High Court to liquidate Kenpong Travel & Tours over a GH¢2.55 million unpaid judgment debt from 2022, plus accruing interest and GH¢20,000 costs.

First Atlantic Bank argued that Kenpong cannot pay its debts, with failed repayment efforts and defective collateral; the case is pending court review under the Corporate Insolvency Act.

A news article by the GhanaChronicles detailed that, “the dispute stems from an earlier lawsuit filed by First Atlantic Bank against Kenpong Travel & Tours and five other defendants. Judgment was reportedly entered against the defendants on August 15, 2022, with the debt currently standing at GH¢2,549,969.28, excluding accrued interest and costs.

The bank further claims that the judgment awarded costs of GH¢20,000 and that interest continues to accumulate at prevailing commercial rates until full settlement of the debt”.

It added, “In its petition, First Atlantic Bank alleges that repeated legal applications by the respondent have delayed enforcement of the judgment. The bank claims that several attempts were made to stay execution of the judgment, all of which were unsuccessful.

The bank also contends that despite years of litigation, the company has failed to present a satisfactory repayment proposal or identify assets capable of settling the outstanding debt”.

“Additionally, First Atlantic Bank alleges that documentation presented as collateral for the facility that resulted in the debt was defective and could not be registered as a valid mortgage by the Lands Commission.

As part of the reliefs being sought, the bank wants the court to order the liquidation of Kenpong Travel & Tours, authorize the realization of the company’s assets to satisfy the debt, and restrain the company’s directors from disposing of or interfering with company assets pending determination of the petition.

However, the filing of a winding-up petition does not automatically mean the company is insolvent. Under Ghanaian law, the petition remains an allegation that must be tested before the court, and Kenpong Travel & Tours has the right to oppose the application, negotiate a settlement, or present evidence demonstrating its financial viability”, the report added.

Kenpong is a well-known Ghanaian firm specialising in supporter travel packages to FIFA World Cups and other major sporting events.

Kenpong case with Bank is set to attract significant public attention, given the company’s profile within Ghana’s travel and tourism industry and its numerous involvement in organising travel packages for Ghanaians to major international events like the World Cup.

Meanwhile, the Commercial Division of the High Court in Accra is expected to hear arguments from both parties before determining whether to place the company into official liquidation.
