‘There is nothing like an invitation under Ghana’s criminal justice system’ – Madina MP

Francis-Xavier Sosu (ESQ), the Member of Parliament for Madina, has said there is nothing like an invitation under Ghana’s criminal justice system.

He argued that no Ghanaian is under any obligation to assist any investigative body in conducting investigations.

Francis-Xavier Sosu stressed that EOCO and other security Agencies are abusing the use of invitations, turning them into arrests.

The Madina MP highlighted that if an investigative body has evidence to place people under arrest, they should go and place the person under arrest and stop with the invitation.

Speaking on Adom FM Dwaso Nsem, Francis-Xavier Sosu (ESQ) stated, “If you look at our criminal jurisprudence, there is nothing like invitation, and so in the first place I do not agree with EOCO for saying they have invited somebody from February and they have not shown up.

What is invitation? No, Ghana is under any obligation to assist any investigative body in conducting investigations. If you feel that someone has come with a complaint and you have evidence to place the person under arrest, go and place the person under arrest.

You cannot come and tell us that you have invited the person, and when I invited you, it has been a long time, but you have refused to come, so I am not coming to arrest you. Nobody does that.

The laws are very clear. We have the substantive criminal justice and the procedural criminal justice, and both must work together”.

His comment follows the attempted arrest of Manhyia South Member of Parliament, Nana Agyei Baffour Awuah by officials of the Economic and Organised Crime Office (EOCO) at the Accra High Court on Wednesday, September 23, 2026.

Meanwhile, the Economic and Organised Crime Office (EOCO) has disclosed that Manhyia South Member of Parliament, Nana Agyei Baffour Awuah, ignored two invitations issued in February 2026 to assist with an ongoing investigation.

According to EOCO, its invitations were not honoured, prompting the Office to take steps to secure the MP’s attendance in accordance with the law.

EOCO revealed that its officers were acting in the lawful discharge of their responsibilities when they attempted to arrest the MP in connection with the investigation.

In a press statement stated, “The Office had previously invited Hon. Baffour Awuah to assist with the investigation on two occasions in February 2026. The invitations were not honoured”.

EOCO explained that the attempted arrest was one of the lawful steps it had taken to secure his attendance after the earlier invitations were not honoured.

According to EOCO, they have identified two persons who allegedly intervened to facilitate the MP’s departure from the scene and are assessing their conduct for possible further action.

EOCO maintained that being a member of Parliament does not by itself bring an investigation to an end or place an individual beyond the reach of the law.

They further disclosed that the investigation remains active and that it will review the circumstances surrounding the incident, including available video evidence, before determining its next steps.
